PARAGRAPH 7.1: ENACTED AND AVAILABLE IN PRACTICE

 

These rights and freedoms set forth in the present Declaration shall be accorded in national legislation in such a manner that everyone shall be able to avail themselves of such rights and freedoms in practice.

Introduction

When the provisions of national legislation, rules and regulations conform to those of the 1981 U.N. Declaration they constitute a guarantee of freedom of religion or belief in a community. As long ago as 1960, Arcot Krishnaswami, in his U.N. commissioned Study of Discrimination in the Matter of Religious Rights and Practices, stressed the importance to be given to clarification of laws and administrative practices that either increased or reduced the scope of freedom of thought, conscience and religion or belief. He considered the actual adoption of legislation as an educational measure.
