Term 6.1.8: Days of Rest, Holidays, Ceremonies

 

To observe days of rest and to celebrate holidays and ceremonies in accordance with the precepts of one’s religion or belief;

Minority religions often have different days of rest from majority religions and secular holidays. Most countries have provisions written into labor laws establishing when a business must allow time off for adherents of a religion or belief to celebrate their days of rest, holidays or ceremonies. The International Labor Organization (ILO) in 1957 issued a Convention titled Weekly Rest in Commerce and Offices. The final paragraph includes a provision relating to freedom of religion or belief; “The traditions and customs of religious minorities shall, as far as possible be respected.” In 1989, the ILO adopted a Convention concerning Indigenous and Tribal Peoples in Independent Countries: “The peoples concerned shall have the right to decide their own priorities for the process of development as it affects their lives, beliefs, institutions and spiritual well being.” If indigenous peoples control their own lands they will have considerable control over the economic, social and cultural development which includes days of rest, holidays and celebrations. It only becomes difficult when indigenous peoples, employed by companies outside of their own legislative control, refuse to allow them time off for spiritual days of rest and holidays.

  • Azerbaijan : The U.N. Special Rapportuer’s report for 2000 stated six Jehovah’s Witnesses, employees of a Baku gas refinery, were fired when they organized study groups during rest work hours to teach the ideas, objectives and purposes of their belief. They were later re-installed after agreeing not to take their rest time to proselytize their beliefs.

Get any government publications regarding national labor laws on days of rest or cultural holidays that pertain to religion or belief. Check with local leaders of religions or beliefs to get the requirements they have for special days of rest, holidays and celebrations. Ask them if their followers have experienced any difficulties with the government or private employers in getting time off to celebrate these days.
